This website is owned and operated by Digital Marketing, a Partnership Firm having its registered office at B-313, Pocket C, Okhla Phase I, Okhla Industrial Estate, New Delhi, Delhi 110020 (hereinafter referred to as "Company," "We," "Us," or "Our").

By accessing, browsing, or using this website, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). These Terms constitute an electronic record in accordance with the provisions of the Information Technology Act, 2000 and the Information Technology (Intermediaries guidelines) Rules, 2011 thereunder, as amended from time to time.

2. Eligibility
By using this Site, you represent that you are at least the age of majority in your state or province of residence. If you are a minor (under the age of 18), you may use this Site only with the involvement of a parent or guardian.

3. Products and Services
We specialize in the retail of electronic gadgets including, but not limited to, Powerbanks, Earpods, Neckbands, Projectors, Smartwatches, and Wired Headphones.

  • Product Description: We attempt to be as accurate as possible. However, we do not warrant that product descriptions, colors, or other content of this site are accurate, complete, reliable, current, or error-free.

  • No Warranty / No Guarantee: You explicitly acknowledge and agree that all products sold on Xome Store India are provided on an "AS IS" and "AS AVAILABLE" basis. We do not provide any warranty or guarantee regarding the longevity, durability, or performance of the electronic items once the 7-day refund window has expired.


4. Pricing, Payments, and Offers

  • Pricing: All prices are listed in Indian Rupees (INR) and are inclusive of applicable GST unless stated otherwise. Prices are subject to change without notice.

  • Payment Methods: We do not offer Cash on Delivery (COD). You must effect payment via the online payment gateways provided on the website.

  • Time-Bound Offers: Any discounts, coupons, or promotional offers published on the website or our social media channels are strictly time-bound. The validity period will be mentioned on the specific post. We reserve the right to revoke any offer at any discretion without prior notice.


5. Third-Party Marketplaces (JioMart Clause)
We actively sell our inventory on third-party platforms, specifically JioMart.

 

  • Separate Jurisdiction: If you have purchased a product listed by Xome Store India via JioMart, your transaction is governed entirely by JioMart’s Terms of Service.

  • Dispute Resolution: Any disputes, return requests, or refund claims for JioMart orders must be directed to JioMart Customer Support. Xome Store India cannot process refunds or service requests for orders not generated directly on www.xomestore.com.


6. User Conduct and Prohibited Uses
You are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (d) to submit false or misleading information; (e) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service.

7. Intellectual Property
All content included on this site, such as text, graphics, logos, button icons, images, audio clips, digital downloads, and data compilations, is the property of Digital Marketing (Xome Store India) or its content suppliers and is protected by Indian and international copyright laws.

8. Limitation of Liability
In no case shall Digital Marketing, our partners, officers, employees, affiliates, agents, contractors, suppliers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service.

9. Indemnification
You agree to indemnify, defend and hold harmless Digital Marketing (Xome Store India) and our partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

10. Governing Law and Dispute Resolution
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of India. The courts in New Delhi, Delhi shall have exclusive jurisdiction in any proceedings arising out of this agreement.
